Hello, I am Miss Young. I received the following email. It is a socalled "Advance Fee Fraud" letter, where I am promised millions for my assistance. These stories are all lies, and if I respond, sooner or later I will be asked to pay a fee. If I pay, another fee will quickly come up, and it will continue that way until I give up or run out of money. I will never see the millions, because they never existed.

BANKING CARD TERMS AND CONDITIONS

WHEREAS

  1. FMW has developed a product known as Banking Card, an Automated Teller Machine Scheme whereby the cardholder uses the issued card at any bank for: Cash Withdrawal from his/her account, Balance Enquiry, Fast Cash, Mini Statement Printout, Full Statement Request, Funds Transfer, Chequebook Request, Bills Payment, Change of PIN and any other services that may be added in the future at any Diamond Bank ATM.

  2. The Cardholder has purchased a Banking Card for the above service and FMW has agreed to provide the above service.

CARD USE

FMW Banking Card may only be used

(a) By the Cardholder

(b) Strictly in accordance with the terms and conditions as set out in this Agreement.

3. SAFEGUARDING THE CARD AND PIN

  1. The cardholder shall exercise all possible care to ensure the safety of the Banking Card in his/her possession.

  2. The cardholder must not disclose the PIN to any other party

  3. FMW shall not be liable for any loss or damage the cardholder may suffer, arising from the cardholder not exercising all reasonable care, in maintaining the safety of Banking Card, or the confidentiality of the PIN.

  4. The Cardholder must never write the PIN on the Banking Card or on anything usually kept with it.

LOST CARDS

  1. Where a card is lost, stolen, mutilated or any other reason liable to misuse, or if the PIN is disclosed, the Cardholder must immediately notify FMW at Plot 657 Adeola Street, Lagos or any branch of DBL.

  2. Notice given orally to FMW shall only become effective when confirmed in writing and upon the actual receipt of such notice by FMW. Where notice as required by this section is not given, the cardholder shall be liable in respect of any use of this card.

  3. The cardholder shall provide FMW with all the information in the cardholder’s possession, regarding the loss, theft, or misuse of Banking Card or the disclosure of the PIN and shall take all necessary steps as FMW may require, to assist in the recovery of the card.

  4. In the event of any loss, theft, misuse, or disclosure being suspected, FMW may provide the police with any information it considers necessary and relevant.

. ARBITRATION

If any dispute arises between the parties, hereto relating to the interpretation and/or application of this Agreement, which cannot be resolved by mutual consultation, such dispute shall be referred to arbitration in accordance with the Arbitration Act, Chapter 19 of the laws of the Federal Republic of Nigeria, 1988 and any amendment thereto.

GENERAL

i. FMW shall not be liable to the cardholder, if FMW is unable to perform its obligations under this Agreement, due (directly or indirectly) to the failure of any machine, data processing system, transmission link, industrial dispute, anything outside the control of FMW, its agents or subcontractors.

ii. The cardholder shall immediately notify FMW in writing of any change in his/her address or name.

iii. This agreement shall be governed by and construed in accordance with the Nigerian law.
